Back40 Forum - Terms of Use
Effective October 28, 2026 · Version 2026-10-28
Back40 Forum is operated by Oettinger Management Group (“Back40,” “we,” “us,” or “our”), based in Indiana, United States. These Terms govern your account and use of back40forum.com. By affirmatively accepting these Terms when registering, you agree to them. If you do not agree, do not create an account or submit content. Our Privacy Policy explains how we handle personal information.
1. Adults-only membership and account security
You must be at least 18 years old and legally able to enter this agreement to create or use a member account. Do not register on behalf of a child. Public pages may be accessible without an account, but the community is intended for adults. Tell us if you believe an account belongs to someone under 18.
Provide accurate registration information, keep your contact email current, use a unique password, and protect access to your account. A screen name is fine; impersonating another person or organization is not. You are responsible for activity you authorize through your account. Notify us promptly about suspected unauthorized access. Do not share credentials or evade a suspension by opening another account. If you act for an organization, you must be authorized to bind it.
2. A discussion forum, not professional or emergency assistance
Back40 provides a place to exchange experiences and general information. Posts, starter guides, checklists, moderator comments, summaries, and linked resources may be incomplete, inaccurate, outdated, or unsuitable for your circumstances. A pinned post, administrator label, or advertising relationship is not verification of a claim, credential, product, or person. We do not provide personalized medical, legal, financial, engineering, electrical, construction, or other licensed professional services through the forum.
Preparedness activities can cause serious injury, illness, property damage, or death. This includes food preservation and wild-food identification; water treatment; medication and first aid; generators, fuel, batteries and electrical work; heating and ventilation; firearms and tools; animal handling; construction; and outdoor travel. Do not rely on a post as your sole basis for a safety-critical decision. Verify information with current authoritative guidance, the manufacturer, local requirements, and a qualified professional. Your participation does not create a professional-client relationship.
The forum is not monitored as an emergency service. For immediate danger, contact local emergency services. Follow official evacuation and public-safety instructions. Never delay medical care or emergency help while waiting for a reply. You are responsible for deciding whether an activity is appropriate and lawful for you; nothing here asks you to assume a risk that applicable law does not permit us to allocate to you.
3. Community rules
Disagree respectfully, describe firsthand experience honestly, and distinguish evidence from speculation. Follow applicable law and the rules posted in each forum. Do not use Back40 to:
- Threaten, stalk, harass, exploit, discriminate against, or dox someone; encourage violence; or publish another person’s private information without a lawful basis.
- Post sexual exploitation, illegal sexual material, nonconsensual intimate imagery, or sexual content involving minors. Do not post graphic violence for shock value or instructions intended to facilitate unlawful harm.
- Commit fraud, impersonate others, create fake testimonials, hide paid endorsements, manipulate discussions with undisclosed accounts, or present invented qualifications as real.
- Post malware, phishing, spam, unauthorized advertising, stolen content, passwords, confidential records, or material that infringes privacy, publicity, intellectual-property, or other rights.
- Offer or arrange unlawful transactions, or use the forum to buy, sell, trade, or facilitate transfers of firearms, ammunition, explosives, controlled substances, or other prohibited or regulated goods. Safety and lawful sporting discussions do not authorize transactions.
- Probe accounts or systems without permission, defeat access restrictions, circumvent a ban, overload the service, or harvest member details for unsolicited contact. Public access is not permission to build marketing lists from members’ personal information.
- Present automated or AI-generated material as firsthand testing or professional expertise. You remain responsible for the accuracy, rights, disclosures, and safety of content you submit, whatever tools you use.
4. Your content and the permission needed to run the forum
You retain ownership of content you create. Submit only material you have the right to share. By submitting content, you give Oettinger Management Group a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, distribute, and technically adapt it as needed to operate, secure, back up, and present Back40 and its discussion features. This includes displaying your public posts next to clearly identified advertising. We may allow hosting and other service providers to perform these functions for us. This license does not transfer ownership or give us unrestricted permission to sell your content as an unrelated product or imply your endorsement of an advertiser.
Public posts, profile information you choose to make public, and attachments may be read, quoted, linked to, indexed, or copied by others. Share only what you are comfortable making public. Do not upload sensitive records, precise home or supply locations, identifying information about children, or someone else’s private information. Check photographs for personal details and embedded location metadata before uploading.
You can request removal of content you identify specifically. Editing, removal, and account closure may be subject to forum controls, discussion continuity, safety investigations, legal obligations, and applicable privacy rights. Account closure does not automatically erase every public post or another member’s independent reply. Where appropriate we may remove identifying details or anonymize retained discussion content. The operating license continues only to the extent needed for content lawfully retained, backups, dispute resolution, or legal obligations. We cannot guarantee removal of copies already made by independent third parties.
Back40’s name, design, and original site materials remain the property of their respective owners. Do not imply that you represent or are endorsed by Back40. Linking to a public discussion is welcome; republishing protected material requires permission or another lawful basis.
5. Moderation, reports, and account closure
We may review, label, move, limit, edit, or remove content and restrict or suspend an account for violations, suspected abuse, security concerns, legal obligations, or other reasonable community-management purposes. We may preserve relevant evidence. We are not required to read every post in advance, verify every statement, or provide continuous monitoring. Moderation decisions do not make us the author or guarantor of member content.
Use the report control on a post where available, or contact us with the URL, username, and a concise explanation. For an account restriction or removal decision you want reconsidered, email the contact below with relevant facts. We will review requests reasonably, but cannot promise a particular outcome or response time for every report. We may limit information we disclose to protect people, investigations, or legal obligations. Immediate threats should also be reported to emergency services.
6. Advertising, affiliate links, and recommendations
Back40 may earn revenue from advertisements, sponsorships, and affiliate links. A purchase through a qualifying affiliate link may earn us a commission. Paid placements and material connections must be disclosed clearly near the relevant content or link. This general notice does not replace a disclosure on an individual recommendation.
Members must disclose employment, ownership, commissions, free products, sponsorships, and other relationships that could affect how readers evaluate a recommendation. Do not post unsolicited promotions or affiliate links without moderator permission. An advertisement or link is not our guarantee of a seller, product, safety claim, price, availability, or result. Third-party purchases are governed by the seller’s terms and privacy practices.
7. Member sales, meetups, and outside arrangements
A Back40 marketplace is not currently open. General gear discussion is not authorization to post listings or solicit transactions through posts or private messages. If we introduce member sales, we will publish separate marketplace rules before enabling them, including allowed items, seller responsibilities, prohibited transactions, and the platform’s role. No paid membership or recurring membership charge is currently offered.
We do not verify every member’s identity, background, ownership claims, qualifications, or suitability. Back40 is not a party, broker, escrow agent, insurer, or guarantor for arrangements members make independently. Use independent judgment when sharing information, visiting property, attending events, exchanging services, or meeting someone. Do not describe an event as officially organized or endorsed by Back40 without our written agreement. Mandatory legal rights still apply.
8. Copyright and other legal complaints
Send infringement reports to the contact below with the subject “Back40 copyright report.” Identify the protected work, the exact URL or material at issue, your contact information, and the basis for your authority to report it. Include a good-faith statement that the use is unauthorized by the rights holder, its agent, or law; a statement that the notice is accurate and, under penalty of perjury, you are the owner or authorized to act for the owner; and your physical or electronic signature. Do not submit a knowingly false complaint.
We may restrict or remove reported material, request additional information, notify the submitting member, and terminate repeat infringers in appropriate circumstances. We consider valid counter-notices and court orders as required by applicable law. We may share relevant complaint details with the affected person, advisers, or authorities when reasonably necessary to resolve the report. Do not include unrelated sensitive information.
9. Third-party services and availability
Links, embedded resources, advertisers, and independent services have their own terms and privacy practices. We do not control them. Back40 may change, interrupt, restrict, or discontinue features for maintenance, security, legal, or operational reasons. Keep your own copies of material you need. We do not promise uninterrupted access, permanent storage, delivery of every notification, or a specific response time.
10. Warranties and limits of liability
To the fullest extent permitted by applicable law, Back40 is provided “as is” and “as available,” without warranties of accuracy, merchantability, fitness for a particular purpose, noninfringement, or uninterrupted or error-free service. We do not warrant member advice, third-party products, or the outcome of any activity discussed here.
To the extent the law permits, Oettinger Management Group and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, business opportunities, or data arising from your use of Back40. To that same extent, our aggregate liability for claims arising from the service will not exceed the greater of US $100 or the amount you paid us specifically for the service in the twelve months before the event giving rise to the claim.
These limits do not exclude or limit liability for fraud, intentional misconduct, gross negligence, or any other liability or remedy that applicable law does not allow us to exclude or limit, including protected consumer and privacy rights. They apply only where enforceable and only to the extent permitted; they are not a promise that every claim is barred.
11. Responsibility for unlawful contributions
To the extent permitted by law, you agree to indemnify Oettinger Management Group against third-party claims and reasonable, documented losses and legal costs resulting from your unlawful content, infringement of another person’s rights, or knowing material violation of these Terms. This does not require you to cover losses caused by our own unlawful conduct. We will give reasonable notice of a covered claim and allow reasonable participation in its defense; no settlement may impose a nonmonetary obligation or admission on the other party without consent.
12. Governing law and resolving disputes
Indiana law governs these Terms, excluding conflict-of-law rules, except where mandatory law gives you protections that cannot be displaced. Contact us first when practical so we can try to resolve a concern. This informal request does not limit your ability to seek urgent relief, complain to a regulator, use an available small-claims procedure, or meet a filing deadline.
Subject to mandatory jurisdiction and consumer-protection rules, disputes concerning these Terms may be brought in the appropriate state courts in Clark County, Indiana, or the United States District Court for the Southern District of Indiana, and the parties consent to those courts. These Terms do not impose mandatory arbitration or a class-action waiver.
13. Changes and other terms
We will date and publish revisions. For material changes affecting member obligations or rights, we will provide a prominent notice and obtain renewed acceptance when required before applying them to affected members. Changes do not retroactively waive accrued rights or authorize unrelated uses of previously collected personal information. New paid, advertising-tracking, or marketplace features require their own applicable disclosures and controls.
If a provision is unenforceable, the remaining provisions continue to the extent permitted by law. A failure to enforce a provision immediately is not a waiver. These Terms and expressly incorporated feature rules govern use of Back40; an advertisement or member post does not amend them. Provisions that reasonably need to survive account closure—such as lawful content retention, dispute provisions, and liability limits—survive within their stated scope.
